Last updated: January 1, 2026These Terms of Service ("Terms") govern your use of the lihkedin.click website and any video production services provided by Rushes Video Production ("Rushes," "we," "us," or "our"), a business located at 1742 Wazee Street, Suite 300, Denver, CO 80202. By using this Site or engaging our services, you agree to these Terms.
1. Acceptance of Terms
By accessing this Site, submitting a contact form, or entering into a production agreement with us, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Site or our services.
2. Description of Services
Rushes provides corporate and brand video production services, including but not limited to brand films, executive interviews, customer testimonials, product and explainer video, event coverage, and post-production editorial services. Specific scope, deliverables, and timeline for each project are defined in a written proposal, estimate, or production agreement signed or confirmed by both parties prior to the start of work.
3. Estimates, Payment & Deposits
- All pricing shown on this Site is illustrative; final pricing is confirmed in a written project quote.
- A non-refundable deposit (typically 50% of the project total) is required to reserve a production date and begin pre-production.
- The remaining balance is due upon delivery of final edited files unless otherwise agreed in writing.
- Late payments may result in a hold on final file delivery and/or a late fee as specified in the project agreement.
4. Cancellations & Rescheduling
We understand plans change. Our standard policy is as follows unless a signed agreement states otherwise:
- Cancellations or reschedule requests made 48 hours or more before the scheduled production date: full refund of any deposit, minus non-recoverable costs already incurred (e.g., booked crew, location fees).
- Cancellations made less than 48 hours before the scheduled production date: deposit is forfeited to cover crew and equipment holds.
- Rushes reserves the right to reschedule due to illness, equipment failure, or conditions outside our control, with no penalty to the client, and will work in good faith to find the next available date.
5. Revisions
Each production package includes a defined number of revision rounds, specified in your project quote. Additional revision rounds beyond what is included will be billed at our then-current hourly editing rate.
6. Intellectual Property & Usage Rights
- Upon full payment, the client receives a license to use final delivered video files for the purposes specified in the project agreement (e.g., website, paid advertising, internal use, social media).
- Rushes retains ownership of raw/unedited footage, project files, and any creative assets not explicitly delivered, unless a separate written agreement transfers ownership.
- Unless otherwise agreed in writing, Rushes retains the right to use final delivered work in its own portfolio, demo reel, and marketing materials.
- Clients are responsible for obtaining any necessary releases, licenses, or permissions for talent, locations, music, or third-party materials they provide or request be used.
7. Client Responsibilities
Clients agree to provide timely access to locations, personnel, and materials needed for production, to secure any required permits or third-party approvals, and to provide feedback on edits within a reasonable timeframe to avoid production delays.
8. Limitation of Liability
To the fullest extent permitted by law, Rushes' total liability for any claim arising from our services shall not exceed the total amount paid by the client for the specific project giving rise to the claim. Rushes is not liable for indirect, incidental, or consequential damages, including lost profits or business opportunities, arising from the use of delivered video content.
9. Equipment & Location Conditions
Rushes is not responsible for delays or production issues caused by conditions outside our reasonable control, including but not limited to weather, venue access restrictions, power availability, or third-party scheduling conflicts.
10. Governing Law & Venue
These Terms are governed by the laws of the State of Colorado, without regard to its conflict of law principles. Any disputes arising from these Terms or our services shall be resolved in the state or federal courts located in Denver County, Colorado, and both parties consent to venue and jurisdiction there.
11. Dispute Resolution
Before initiating formal legal action, both parties agree to attempt to resolve any dispute informally by contacting the other party in writing and allowing 30 days for a good-faith resolution.
12. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date above reflects the most recent revision. Continued use of the Site after changes constitutes acceptance of the revised Terms.
